Note: We are only a marketplace and do not provide any representations, warranties, or guarantees regarding the quality or condition of the vehicles listed on our website. You are responsible for inspecting the vehicles before placing any bid or agreeing to purchase any vehicle.

You agree that you may not withdraw, delete, or cancel any bid for any reason.

You agree that you are obligated to pay the amount of any bid (plus all applicable fees) that you place or authorize (or that is otherwise placed or authorized through or under your Member Account) if your bid is accepted. This includes all bids placed during the Preliminary Bidding Period as well as during the live Virtual Auction and applies regardless of how and where your bid was placed.

You understand that Copart may reject your bid.

Copart or IAAI (as the auction operator) may, at its sole discretion, reject or cancel any bid at any time and for any reason without prior notice to you or StatVIN. 

You acknowledge and agree that any such rejection or cancellation is not within our control or discretion, and you hereby release us from any related liability, damages, or losses.

You understand that we, one of our Dealers, or Copart may cancel the sale.

StatVIN, one of our Dealers, Copart, or IAAI, as auction operators, may postpone, cancel, unwind, or withdraw any vehicle from sale at any time and for any reason without prior notice. 

You acknowledge and agree that any such postponement, unwinding, cancellation, or withdrawal may not be within our control; however, even if it is, you hereby release StatVIN, our Dealers, Copart, and IAAI from any related liability, damages, or losses, including (but not limited to) any additional costs you may have incurred in connection with the vehicle and/or its purchase.

You may use the Bid4U system to make the bidding process easier and more efficient.

Copart or IAAI, as the auction operator, may use the Bid4U system, which allows bidders to enter a pre-bid amount reflecting the maximum price you are willing to pay for a specific vehicle. 

The Bid4U system will place incremental bids on your behalf (up to your specified maximum bid amount) during the Preliminary Bidding Period and during the live Virtual Auction.

The Bid4U system will increase your bid only one increment above the current highest bid to maintain your position as the highest bidder, which may allow you to purchase the vehicle for less than your maximum bid. 

If the current highest bid exceeds your maximum bid, you will be notified by email, and, if sufficient time remains before the auction ends, you may increase your maximum bid. Bid4U may not be available for all auctions.

As with any other bid, once you place a bid through the Bid4U system, it is binding and cannot be canceled or withdrawn.

Bids placed during the live auction take precedence over pre-auction bids of the same amount.

Bids placed during the live Virtual Auction take priority over any bids of the same amount placed during the Preliminary Bidding Period. For example, if you set a maximum bid of one thousand US dollars ($1,000) during the Preliminary Bidding Period, and someone places a bid of one thousand US dollars ($1,000) during the live Virtual Auction, you will lose unless you increase your bid during the live Virtual Auction.

If you select the “Buy It Now” option, you are obligated to purchase the vehicle at the listed price.

Some vehicles are offered for sale with a “Buy It Now” option, which allows you to purchase the vehicle immediately at the price set by the auction seller before the vehicle is put up for bidding.

 If you select the “Buy It Now” option, you are obligated to purchase the vehicle at the listed auction price plus StatVIN fees, Copart fees, and any other applicable fees as outlined in the Terms and Conditions you agreed to. You may not withdraw, delete, or cancel a Buy It Now bid for any reason.

Your highest bid is binding, even if the seller submits a counteroffer. A seller’s counteroffer does not cancel your bid.

You understand and agree that even if the seller makes one or more counteroffers, such counteroffers do not change the binding nature of your highest bid, Buy It Now, or Make An Offer. 

The amount of your highest bid submitted to the seller constitutes an offer that cannot be withdrawn or canceled and remains valid regardless of any counteroffers. 

You understand and agree that your highest bid is not considered accepted or rejected until you receive a corresponding notification from us. 

The seller has until 7:45 PM PST on the next business day following the live auction to negotiate, accept, or reject your highest bid. Make An Offer bids remain valid for two (2) business days (48 hours, excluding weekends) after the day the offer is placed. If the seller takes no action within this period, the obligation expires and becomes null and void.

For example, you place a bid of five thousand US dollars ($5,000) on Vehicle A, and your bid is the highest at the end of the auction.

 After the auction ends, the seller makes a counteroffer of six thousand US dollars ($6,000). Even if you do not accept the seller’s counteroffer of $6,000, the seller may still accept your highest bid of $5,000 until 7:45 PM PST on the next business day.

 You may not withdraw or cancel your bid, even if the seller makes one or more counteroffers.

You agree that your highest bid is not considered accepted or rejected until you receive notification from us. 

You also agree that the acceptance or rejection of your bid for a vehicle with the status “On Minimum Bid” is not within our control or discretion, and you hereby release us from any related liability, damages, or losses.

You understand that some vehicles are sold “On Approval.”

Even if you have placed the highest bid, you have not purchased the vehicle if it is sold “On Approval” unless and until Copart (as the auction operator) notifies us that your bid has been accepted. 

In some cases, the seller of a vehicle with the “On Approval” status may require up to 3 business days (including the auction date) to provide Copart with notice of bid acceptance.

You agree that your bid is not considered accepted or rejected until you receive a corresponding notification from us, even if you do not receive such notification within 3 business days.

You further agree that the acceptance or rejection of your bid for vehicles sold “On Approval” is not within our control or discretion, and you hereby release us from any related liability, damages, or losses.

You understand that some vehicles are sold with the status “On Minimum Bid.”

A vehicle sold with the status “On Minimum Bid” means that the seller has set a minimum bid or reserve price prior to the auction.

 If you are the highest bidder and your highest bid meets or exceeds the minimum bid, you will be obligated to purchase the vehicle at the conclusion of the auction. 

However, if you are the highest bidder but your bid does not meet or exceed the minimum bid, the vehicle will not be awarded to you at the end of the auction.


Instead, after the auction ends, you will have the option to: 
 

  • keep your highest bid, 
     
  • increase your highest bid.
     

Additionally, the seller will have the option to: 
 

  • accept your highest bid,
     
  •  reject your highest bid, 
     
  • make a counteroffer.

Our Win Guarantee helps increase your chances of winning vehicles listed as “On Approval” or “On Minimum Bid.”

Under our Win Guarantee, you authorize us to negotiate directly with the seller in order to purchase the vehicle for an amount equal to or less than your maximum bid or the seller’s reserve price (whichever is lower), plus applicable fees. We will conduct negotiations by increasing the amount in small increments, aiming to secure the best possible price for resale to you.

The title you receive may differ from the state title or ownership document type listed on the lot page.

Due to differences in applicable laws, when purchasing a vehicle from another state, you may receive a title or ownership document that differs from the title or ownership document listed on the lot page. 

For example, depending on your location, if you are a resident of Idaho and purchase a vehicle currently located in Nevada, you may receive an Oregon salvage title certificate. Processing times for different (but similar) titles or ownership documents may range from 5- 7 weeks and may result in additional fees.

Special requirements apply for California residents.

If you are a California resident, you may purchase vehicles through our Service via one of our Dealers by following our standard process, provided that the vehicle you are purchasing is not located in California.

If you are a California resident and the vehicle you wish to purchase is currently located in California, a different process must be followed, as we do not sell vehicles in California. All bids placed through our online membership platform will be executed by a Dealer.
 

All payments will be processed through our online membership platform on behalf of the Dealer. Our affiliated Dealer will sell you the vehicle and provide the appropriate sales documentation, as described below. All purchases made by California residents through our Dealers will include California sales tax.

If a California resident purchases a vehicle located in California, the buyer will not receive the title listed on the lot page. Instead, the buyer will receive an Acquisition Bill of Sale.

 The Acquisition Bill of Sale may be converted into a salvage title when registering the vehicle in the state of California. The vehicle must pass various inspections before it can be registered.

Note: That we do not assist with repairs, registration, or inspections. 

Whether a vehicle sold with an Acquisition Bill of Sale can be registered in different states is determined by the respective states, and therefore we do not guarantee that such a vehicle will be eligible for registration.

If a California resident wishes to purchase a vehicle located in California that is listed with a non-repairable title, such a vehicle cannot be registered in California.

If a California resident wishes to purchase a vehicle located in California for export, please notify us before placing a bid on any vehicle. In order for a California resident to purchase a vehicle in California for export, the buyer must have a clean title issued in their name, and an Acquisition Bill of Sale is not accepted as a clean title for export. 

By notifying us in advance, we will be able to provide you with a clean title marked “Export Only.”
